A private trust is a natural person by definition. That natural person CAN do whatever it wants, including being a director of a legal entity. However, if you use a private trust in that public legal capacity, it is no longer public. It has conferred jurisdiction to the public forum by acting in that capacity. I'm planning to go offshore with new companies. Certain jurisdictions allow legal entities such as corporations to be shareholders, but not directors of their companies (e.g. LLCs, IBCs).

Is a private express trust, a natural person? If so, does it mean that such jurisdictions will allow a private express trust to be a director?

here is a tip for the Ozzy people, use notary's very carefully, as public notary's in Oz put your public trust identification information on the document... so it is probably better to use two or even three witnesses

I just got off the phone with Orion. I think this study group is a great idea, and I recommend taking advantage of this opportunity to network with other members and form trust relationships. Jack, your post is dual minded. Either a trust is private or it is public. It can't be both. And it will not be outside US jurisdiction, at least not completely, if it makes minimum contacts in the federal forum, which it will as you describe. It will become public as soon as it does. However, a holding trust can be formed privately and avail itself to only limited public jurisdiction as it desires, which is what you will want to do for the circumstances you describe. This trust I'm creating will be outside US jurisdiction, and needs to be both public and private because it will be liening an already existing US public trust.

The EIN is needed because the trustee of the public trust being liened needs to be able to identify the trust that the res will be transferred to.

I cannot get the IRS to issue an EIN for the trust unless the trustee has a SSN, and I don't want the new trust falling back into US jurisdiction.

There are some non harmful stabilizers in 3% off the shelf peroxide so no worry to use it orally either. If some property is used as a naked owner (possession, beneficial interest) but there has not been a trustee designated as the controlling party, a construct trust may be instituted by the county/state/federal goons, yes?

I would say if they issue the number then you are entering their jurisdiction. One way to possibly overcome this problem would be to have the holding trust that holds this asset issue it's own ID number and then the trust could put the FAA and any other agency on NOTICE that this is how the trust property will be traveling. Or just don't number it and fly below the radar!
